“Club Med South Africa Villas-Suites (the “Development”) is not owned, developed, or sold by Club Med SAS or its Affiliates. Tinley Leisure Proprietary Limited, a company incorporated under the laws of the Republic of South Africa (the “Developer”), is independently owned and operated and is solely responsible for the ownership or development of the Development.
The Developer uses the Club Med Brand pursuant to a limited, non-exclusive, non-transferable and non-sublicensable license from Club Med SAS. Under certain circumstances, the agreement for providing license may be terminated or revoked according to its terms in which case neither the Suites nor any part of the Development will be identified as a Club Med branded project or have any rights to use the Club Med Trademarks. Club Med SAS does not make any representations or guarantees with respect to the Suites or the Development and is not responsible for the Developer’s marketing practices, advertising, and sales representations.”
